The Romanian Railway Safety Authority - ASFR is established, organized and operates on the basis of OG no. 14/2023 and HG no. 309/2023.

The organizational structure and the organization and operation regulations of ASFR are established by the provisions of OMTI no. 639/2024 and respectively of OMTI no. 688/2024.

ASFR fulfills all the attributions of the safety authority defined in art. 3 point 4 and art. 16 para. (2) from GEO no. 73/2019 regarding railway safety. ASFR's duties are established in the ANNEX "Framework regulation for the organization and operation of the Romanian Railway Safety Authority - ASFR" to GD no. 309/2023 regarding the organization and operation of the Romanian Railway Safety Authority - ASFR.

ASFR fulfills its duties in an open, non-discriminatory and transparent manner, ensuring that all parties are heard and that decisions are motivated. It responds promptly to requests and requests, communicates its requests for information without delay and adopts all decisions within the regulated period from the provision of all requested information. It may at any time request technical assistance from the infrastructure manager and railway transport operators or other qualified bodies, in the course of performing the tasks.

In the process of developing the national regulatory framework, ASFR consults all involved persons and interested parties, including the infrastructure manager, railway transport operators, manufacturers and maintenance providers, users and railway staff representatives.

ASFR is free to carry out all inspections and activities necessary for the performance of its tasks and is granted access to all relevant documents and premises, facilities and equipment of infrastructure managers and railway transport operators. In this sense, in the exercise of state control and inspection attributions, ASFR's specialized staff has the right of access and control on all means of railway transport and on the metro, including in their driver's cab, in the specific railway units that operate under the authority or subordination of the Ministry of Transport and Infrastructure, in the units of railway transport operators, in the units of the administrator and managers of railway infrastructure, industrial railways or rolling stock, as well as in the units of economic operators that supply products or provide services for the railway and metro , based on the special identification card issued and under the regulated conditions.

ASFR carries out an active exchange of opinions and experience with the safety authorities of the member states of the European Union in order to harmonize the decision-making criteria throughout the Community. Their cooperation aims in particular to facilitate and coordinate the safety certification of railway transport operators who have been granted international routes.

The European Union Agency for Railways supports the safety authorities in carrying out these tasks.
