LICENSING

The performance of rail transport services of goods and/or passengers, in the public interest and/or in their own interest, can be done by economic operators who cumulatively hold a license corresponding to the type of service to be performed and a safety certificate issued in accordance with the legal provisions in force.

Railway transport license - the authorization granted by the Romanian Railway Safety Authority - ASFR to a company, which recognizes its ability to provide railway transport services as a railway transport operator. Through the transport license, only certain types of rail transport services can be allowed. The license is accompanied by the financial coverage of civil liability, annexed to the license, which is updated at the due date of the insurance contract or the presented guarantees.

Licenses granted by the Authority of Romanian Railway Safety - ASFR are valid for an indefinite period, in compliance with the requirements that were the basis of their granting or modification, under the conditions of re-examination at intervals of 2 years in order to periodically review.

The railway transport licenses granted by the authorities responsible for licensing in the EU member states are valid on the territory of Romania for equivalent railway transport services, if the minimum levels required by the civil liability coverage provided at the national level are respected.

The economic operator holding a license can request its modification, as a result of the modification of the identification data, namely name, registered office address, contact data, as well as the extension or restriction of the services provided in the license.

ASFR annually carries out verifications of the possession of the financial capacity to carry out the operational activity and verification actions at the headquarters/ workpoints of the operator holding a license in order to assess the way in which the requirements that were the basis for the granting/reexamination or modification of licenses are respected and maintained of railway transport.

The performance of only railway shunting services on the railways in Romania, in the public and/or private interest, can be done by economic operators who cumulatively hold a license corresponding to the type of service to be performed and a safety certificate issued in in accordance with the legal provisions in force.

License for the performance of railway shunting services only - the document granted by the Romanian Railway Safety Authority - ASFR to an economic operator recognizing its ability to perform only railway shunting services in the public interest and/or in its own interest on the railways in Romania . The license is accompanied by the financial coverage of civil liability, annexed to the license, which is updated at the due date of the insurance contract or the presented guarantees.

Economic operators can carry out the intermediation of the transport activity on the railway only on the basis of the license for the intermediation of the transport activity on it.

License for intermediation of the transport activity on the railways in Romania - the document granted by the Romanian Railway Safety Authority - ASFR to an economic operator which recognizes its ability to carry out activities for the organization of goods transport operations on the railway, with taking over the responsibilities of a shipper, without carrying out rail transport activities.

The railway transport intermediary license entitles the holder to connect the client with one or more railway transport operators or between the client and other railway transport intermediaries.

The license for intermediation of the railway transport activity is valid for an indefinite period, in compliance with the requirements that were the basis of its granting or modification, under the conditions of re-examination at 2-year intervals for periodic review.

The railway transport intermediary can request the modification of a license, as a result of the modification of the identification data, namely name, registered office address, contact data, as well as the expansion or restriction of the activity / work points.

Economic operators can perform urban metro transport services only if they hold a cumulative license for urban metro transport and a safety authorization to operate metro lines for the transport of passengers.

The license for urban transport by metro - the document granted by the Romanian Railway Safety Authority - ASFR to an economic operator recognizing its ability to perform urban transport services by metro. The license is accompanied by the financial coverage of civil liability, annexed to the license, which is updated at the due date of the insurance contract or the presented guarantees.

The license for urban transport by metro is valid for an indefinite period, in compliance with the requirements that were the basis of its granting or modification, under the conditions of re-examination at intervals of 2 years in order to periodically review.

ASFR annually carries out verifications of the possession of the financial capacity to carry out the operational activity of urban transport with the metro.

The operator of urban transport with the metro can request the modification of a license as a result of the modification of the identification data, namely name, registered office address, contact data.
